Terms and Conditions
Terms and Conditions
Definitions
-
roooted, Friedhofstr. 4, 97241 Bergtheim, offers events in the creative/leisure sector.
-
"Customer" and contractual partner of roooted is the entrepreneur or consumer who places the order and is liable for payment.
-
"Booking" includes both the process of selecting and completing a purchase via the website and the specific order of tickets, kits, or vouchers.
-
The following General Terms and Conditions apply exclusively to the booking of one of our events/products. They are deemed to be agreed upon when the customer sends the order, unless the customer objects to them immediately after becoming aware of them. They also apply if the customer uses general terms and conditions and these contain conflicting or deviating conditions from the General Terms and Conditions listed here. Exceptions to this require explicit written confirmation from roooted. Any counter-confirmation by the customer referring to their general terms and conditions is hereby expressly rejected.
-
roooted reserves the right to amend the General Terms and Conditions for objective reasons (e.g., changes in law or jurisprudence, changes in economic conditions or business model). The customer will be notified in writing of any such changes before they take effect. If the customer does not object in writing within six weeks of notification, the changes shall be deemed accepted.
Services
-
roooted regularly organizes public events with defined themes. Locations, dates, and themes are presented at www.roooted.de and, if available, can be booked.
-
roooted also offers the possibility, via this website, after prior individual consultation, to book a private event in a selected city/location on a selected topic and date and occasion ("Private Event").
-
Vouchers for nominal values in euros can also be purchased via the form, which in turn can be used to book public events via the website. Please enter the voucher number in the text field when booking. This will be offset later.
Conclusion of Contract
-
Tickets for public events and vouchers can be ordered via the website.
-
Registration is not required. However, the customer must provide the information marked as mandatory fields during the ordering process.
-
The booking data will be sent to the email address provided by the customer in the order confirmation and is also stored and retrievable at roooted.
-
The customer is responsible for ensuring that the email address provided by them during the order is error-free, correctly configured (e.g., regarding SPAM filters), and their email account has the necessary free storage space.
-
The customer can view and download these General Terms and Conditions on the website both before and after placing an order.
Right of Withdrawal
As a consumer, you generally have a statutory right of withdrawal when concluding a contract with roooted via a so-called distance selling transaction.
However, according to § 312g Abs. 2 Nr. 9 BGB, this does not apply to the booking of a specific event (private or public, on-site, virtual or as a live event). Therefore, you cannot revoke your declaration of intent aimed at purchasing a ticket for a roooted event. According to § 312g Abs. 2 Nr. 9 BGB, the right of withdrawal does not apply to contracts for the provision of further services in connection with leisure activities if the contract provides for a specific date or period for the provision. The events offered by roooted are such services in the field of leisure activities on a specific date or period. Thus, every booking of an event is legally binding upon acceptance by roooted and obliges the customer to accept and pay.
Prices, Rebooking & Cancellation
-
The stated prices are total prices. No VAT is shown due to the application of the small business regulation according to § 19 UStG. Plus shipping costs for postal delivery, if applicable.
-
The claim for remuneration by roooted arises upon conclusion of the contract.
-
Payment methods available to the customer are those indicated on the website during the ordering process.
-
roooted allows its customers, in individual cases and as a gesture of goodwill, to rebook or cancel tickets for public events. Cancellation or rebooking requests must be sent to customer service via email. The approval of a rebooking or cancellation is decided on a case-by-case basis and is at the discretion of roooted.
-
The following applies to private events: In the event of cancellation up to 14 days before the event, a fee of 20% of the invoice amount (deposit) is due. After this period, the entire invoice amount is due. A change of date will be decided on a case-by-case basis and is at roooted's discretion.
Changes / Cancellation / Postponement of the Event
-
roooted is entitled to make content changes to booked events, provided that the changes are not substantial, are necessary, and do not significantly impair the overall content of the event. An insubstantial change would be, for example, if the host leading an event has to be replaced because they are ill, the location has to be changed for organizational reasons, or the time of an event is shifted by a maximum of one hour for organizational reasons. In the event of a substantial change to essential content of the booked event, the customer will be informed immediately and is entitled to rebook another event free of charge or to receive a voucher for the value of the booked event.
-
roooted is entitled to cancel an event at short notice for good cause, for example if the host entrusted with the execution of the event no longer cooperates with roooted, the event is canceled or has ceased its business operations, or due to illness, bad weather, or other cases of force majeure. In this case, the customer will be informed immediately and is entitled to rebook another event free of charge or to receive a voucher for the value of the booked event.
-
The execution of individual events may be subject to a certain minimum or maximum number of participants. If the required minimum number of participants for an event is not reached, roooted is entitled to cancel the event no later than five days before the event date. Customers affected by the changes will be informed immediately and can rebook another event free of charge or receive a voucher for the value of the booked event.
-
In case of price differences between events in the event of a rebooking, the respective difference will be refunded or must be paid by the customer.
